Negotiated regulations for the use of McFrancis electronic services

Accessing and browsing the McFrancis web portal constitutes unconditional acceptance of these General Terms and Conditions. The User declares that they have read, understood, and accepted the clauses contained herein, committing to the principles of Good Faith and Fairness (art. 1175 c.c.).
The property listings, descriptions, and prices displayed on the portal are for indicative purposes only and DO NOT constitute a public offer pursuant to Art. 1336 of the Civil Code, but rather a mere invitation to treat (invitatio ad offerendum). No contractual obligation arises for McFrancis by the mere fact of the publication or viewing of the advertisements.
The entirety of the content (text, source code, databases, graphic works) is the exclusive property of McFrancis and is protected by Copyright Law 633/1941. Any reproduction, even partial, without written authorization constitutes a civil and criminal offense punishable by law.
While the Company exercises the utmost professional diligence, it does not guarantee the absence of errors or inaccuracies in the information provided by third parties. Except in cases of willful misconduct or gross negligence (Art. 1229 of the Italian Civil Code), McFrancis is exempt from any liability for direct or indirect damages arising from the use of the platform or reliance placed on the information contained therein.
The legal relationship is governed by Italian Law. For any dispute arising from the interpretation or execution of this agreement, the competent Court shall have exclusive jurisdiction. If the User qualifies as a Consumer, the mandatory jurisdiction of their place of residence or elected domicile shall apply, pursuant to Legislative Decree 206/2005 (Consumer Code).
The platform employs the advanced 'Janus II' security architecture, built on trustless principles and robust encryption to ensure the integrity and confidentiality of digital transactions. While the infrastructure utilizes military-grade cryptographic standards (e.g., SPKI digital signatures, SCT tokens), the User acknowledges that security is a shared responsibility and agrees to diligently safeguard their devices and access credentials, exempting the Operator from liability for unauthorized access arising from User negligence.
Access to the management platform by employees, collaborators, and authorized personnel is conducted through strong authentication protocols that ensure the unique accountability of operations (Principle of Non-Repudiation). Every instance of access to or modification of decrypted data is tracked in immutable logs. The Company shall not be held civilly or criminally liable for any data exfiltration, misuse, or breaches of confidentiality committed by authorized operators acting with intent or gross negligence, in violation of corporate security policies and through the abuse of their granted privileges.
The Company shall not be liable for any delays or failures to perform resulting from force majeure or fortuitous events, including but not limited to: natural disasters, large-scale cyberattacks, widespread network or power outages, and government actions. In such instances, obligations shall be suspended for the duration of the impediment, and the User shall not be entitled to any compensation or damages.
McFrancis may make changes to these Terms for legal, security, or organizational reasons, providing notice by publishing them on the website and, where appropriate, via email. Such changes will take effect 15 days after publication, unless adjustments are required by mandatory regulations.
The following are prohibited: (i) scraping or massive data extraction; (ii) performing intrusive testing or vulnerability scans without authorization; (iii) reverse engineering software components; (iv) sharing credentials or bypassing security mechanisms. Any violation will result in the termination of the agreement and the obligation to compensate for damages.
